If I get hurt on the job, how long do I have to report the injury to my supervisor? |

You have twenty-four hours (24 hrs.) to report the injury to ensure that you are eligible for on-the-job injury leave with pay. Workers' Compensation laws, which provide guidance to the Board of Adjustment, require that an injured employee provide written notice to his or her employer within five (5) days of the injury. |

Even though you may think it is not serious, you should still report the injury to your supervisor immediately. |

How long will it take to receive payment after I file a claim? |

As of August 2008, it takes at least three months after the Board of Adjustment receives a claim before that claim may be paid. The Board of Adjustment typically forwards a claim to the Department of Education about three weeks after the Board of Adjustment receives that claim. Then, if a recommended settlement offer is made by the Department of Education, the Board of Adjustment still must approve that offer. Currently, that approval takes approximately eight weeks. If a claimant has not submitted sufficient information with the claim then any payment of the claim will be delayed. |

What happens if the Department recommends against paying my Board of Adjustment claim? |

The claim is automatically set for hearing. Hearings are generally held three (3) times per year. |

What is the Board of Adjustment? |

The Board of Adjustment was created by the Alabama Legislature in 1935 to provide a monetary remedy to individuals when State immunity would prevent any recovery in a court of law. Among other things, the Board of Adjustment has jurisdiction over on-the-job injury claims for Alabama public school employees. The Board of Adjustment is not a part of the Alabama Department of Education. When the Board of Adjustment receives a claim, it forwards that claim to the state agency involved. That agency then provides a recommendation to the Board of Adjustment. Ultimately, the Board of Adjustment decides whether the claim is paid. §41-9-61 of the Code of Alabama states that the Board of Adjustment will be composed of the Director of Finance, the State Treasurer, the Secretary of State and the State Auditor.
